Prevention of Domestic Violence Act New Jersey

The Prevention of Domestic Violence Act (PDVA) of New Jersey, enacted in 1991, is a comprehensive law designed to protect victims of domestic abuse and provide legal remedies against offenders. The Act defines domestic violence as any of 19 specific criminal offenses, including assault, harassment, stalking, and terroristic threats, when committed by a person with whom the victim has a qualifying relationship, such as a spouse, former spouse, dating partner, or household member.

Under the PDVA, victims can seek Prevention of Domestic Violence Act New Jersey immediate protection through Temporary Restraining Orders (TROs), which can be made permanent through a Final Restraining Order (FRO) after a court hearing. These orders can grant relief such as prohibiting contact, removing the abuser from a shared residence, and awarding temporary custody of children. Violating a restraining order is a criminal offense.
