Hi Scott,
just trying to make some promotion for OFBiz.... Regards, Hans P.S. When you are kicked or criticized remember it is often done because it gives the kicker a feeling of importance. Hans,
Your p.s. is very rude and I don't appreciate it. Please check the guidelines about using Apache names and how wrong it is to give the impression of providing official ASF resources when it is not the case. You are breaking the rules and I'm simply letting you know about it. As I said, if you want to promote OFBiz then hand the account credentials over to the PMC and remove your company's name from the description. May i remind you that your company provided hosting services and was named on the front page for that? I still thank your company for that. May remind you that your company sponsored the entity diagrams and was mentioned in this twitter services? I still thank your company for that. May i remind you that i currently keep the demo site running (need at leas a restart every day) and are not mentioned on the front page for that? May i remind you i am in the PMC too so the PMC is actually is control? And now you are criticizing that i cannot mention that this twitter service is provided by Antwebsystems? Hans, Scott,
Hans: we all thank you for your help on the demo server. There is no problems making advertissement for your company (or anyone else). It seems the problem is in the name apache_ofbiz which looks like an official chanel. Scott: but then yes, what about ofbizbyhotwax and ofbiz_help, etc. less confusing I'd say, nor clean. The point is maybe they don't appear on the official site main page. From a legal POV you can't use the logo and name if it's not an official chanel On the on the other hand I'm sure Hans want to help :o) So maybe simply removing the logo+name + reference to Antwebsystems.com will be sufficient. For the link on main page we should create an official chanel (Like I did for the blog a year ago, but I never used it really, at least yet) That's how I usee things, and I don't think we need to speak privatly of a such issue (actually I think we need to discuss it as open as possible, so dev ML is OK) Jacques From: "Hans Bakker" <[hidden email]> > Scott. > > May i remind you that your company provided hosting services and was > named on the front page for that? I disagree, using the term ofbiz to describe a feed about ofbiz is perfectly acceptable. Neither of those feeds make any attempt to appear to represent the project or the ASF, not in the Name, Website, Bio or through the use of logos. Sorry but I still think that a disclaimer is needed. On the Twitter account page for instance, maybe not though if there are any ambiguities, and then when it begins and where it ends... BTW I don't care much about all that, I just tell the rule I learned for the demos I provided some times. At this moment I created a specfic logo "Powered by OFBiz" but I did not find the courage to make a new one since. Hi Scott:
Perhaps you are correct. But, these guys are lawyers. What we "think" and what is legal are two different matters entirely. The truth of the matter, as it applies to Han's application and as far as it was explained to me through several written exchanges with the legal team, is that anyone may use the logo and/or the name including "Apache Open For Business", "OFBiz" and "Apache OFBiz" as long the registered trademark symbols are clearly visible (at least one time within close proximity of usage.) Yes and what they said vs. what your interpretation of what they explained to you are also two entirely different matters. Proper attribution is only one aspect of the ASF's trademark policy and it is all pretty well explained here: http://www.apache.org/foundation/marks/ That document makes it pretty clear that attribution is not the only concern. > The truth of the matter, as it applies to Han's application and as far as it was explained to me through several written exchanges with the legal team, is that anyone may use the logo and/or the name including "Apache Open For Business", "OFBiz" and "Apache OFBiz" as long the registered trademark symbols are clearly visible (at least one time within close proximity of usage.) > Regards, > Ruth > > Scott Gray wrote: >> On 4/03/2010, at 10:53 AM, Ruth Hoffman wrote: >> >> >>> Hi Hans: >>> >>> Jacques Le Roux wrote: >>> >>>> Hans, Scott, >>>> >>>> Hans: we all thank you for your help on the demo server.
