Hi Daniel (and any person in the same situation),
I have noticed "your" site at http://www.ofbiz.cl Like did for instance Marco Risaliti some time ago with http://www.ofbiz.it you need to clearly state that your site is not and official Apache OFBiz site. The same applies to ofbiz.nl and ofbiz.th (maybe it's done but I did not find it clear like did Marco) and I guess others... This is the minimum required, and actually you should not even use ofbiz in your domain names... http://www.apache.org/foundation/marks/#domains see also there "Using the Apache Foo or similar graphic logos:" Thanks Jacques PS : I think it's ok for http://www.myofbiz.com because it does not '"mimic" official OFBiz site and does not use ofbiz in its domain name. Though a little note about not being an official Apache OFBiz site would not hurt... The same apllies for http://www.ofbiz.biz/ http://www.ofbiz.de/ etc. (you know better than us... for now...) This my own interpretation of the ASF rules and I don't act on behalf of APache OFBiz PMC, but I think I'm right to ask |

Hi Jacques & List:
I've had this discussion with the Apache Foundation in the past as I too am concerned about copyright infringement and misrepresenting my purpose. The Foundation's legal advisers found my "interpretation" of the rules satisfactory. FYI, I do clearly state the relationship with the Apache Foundation here: http://www.myofbiz.com/control/faqs More specifically, I clearly write: Is MyOFBiz.com affiliated with the Apache Foundation or Apache OFBiz? No. Best Regards, Ruth On 4/17/12 5:19 AM, Jacques Le Roux wrote: > Hi Daniel (and any person in the same situation), > > I have noticed "your" site at http://www.ofbiz.cl > > Like did for instance Marco Risaliti some time ago with > http://www.ofbiz.it you need to clearly state that your site is not > and official Apache OFBiz site. > > The same applies to ofbiz.nl and ofbiz.th (maybe it's done but I did > not find it clear like did Marco) and I guess others... > > This is the minimum required, and actually you should not even use > ofbiz in your domain names... > http://www.apache.org/foundation/marks/#domains > > see also there "Using the Apache Foo or similar graphic logos:" > > Thanks > > Jacques > PS : I think it's ok for http://www.myofbiz.com because it does not > '"mimic" official OFBiz site and does not use ofbiz in its domain > name. Thanks Ruth,
I think it's pretty clear, even if a small sentence about it on the main page would not hurt ;o) Anyway, if you got ASF consent I have nothing more to say Jacques From: "Ruth Hoffman" <[hidden email]> > Hi Jacques & List: > > I've had this discussion with the Apache Foundation in the past as I too > am concerned about copyright infringement and misrepresenting my > purpose. Hi Jacques:
Thanks for pointing this out. Initially I thought that no one really cared. Next update to the site I will add such a disclaimer. Thanks Daniel,
I think you can stay as is for the appearance, as long as nobody complains The problem is actually more about ofbiz in the domain name. But you are not alone in this situation and nobody complained for others so far... Other opinions? Hi Guys,
I again stumbled upon this today. Could you please do the same than Daniel did at http://www.ofbiz.cl/ ie add the sentence "This site is not an official Apache Software Foundation Site" and its translation for the corresponding languages As far as I can tell are at least concerned http://www.ofbiz.nl/control/setSessionLocale?newLocale=nl http://www.ofbiz.nl/control/setSessionLocale?newLocale=th http://www.ofbiz.biz/ http://www.ofbiz.de/ If you know any other concerned sites please let us know in order for us to contact them directly Thanks in advance Jacques From: "Jacques Le Roux" <[hidden email]> To: <[hidden email]> Sent: Tuesday, April 17, 2012 11:19 AM > Hi Daniel (and any person in the same situation), > > I have noticed "your" site at http://www.ofbiz.cl > > Like did for instance Marco Risaliti some time ago with http://www.ofbiz.it you need to clearly state that your site is not and > official Apache OFBiz site. > > The same applies to ofbiz.nl and ofbiz.th (maybe it's done but I did not find it clear like did Marco) and I guess others... > > This is the minimum required, and actually you should not even use ofbiz in your domain names... > http://www.apache.org/foundation/marks/#domains > > see also there "Using the Apache Foo or similar graphic logos:" > > Thanks > > Jacques > PS : I think it's ok for http://www.myofbiz.com because it does not '"mimic" official OFBiz site and does not use ofbiz in its > domain name.
